    • In 2014 the House of Lords found that the current Deprivation of Liberty Safeguards (DoLS) system was bureaucratic and too complex.  In the same year the Supreme Court judgement in Cheshire West expanded the definition of liberty.

      The Liberty Protection Safeguards (LPS) were introduced in the Mental Capacity (Amendment) Act 2019.  

      It was intended for the LPS to replace DoLS in April 2022.  However, the Government has announced a delay in the implementation, and a revised implementation date is not yet available.

    • The East Riding Adult Social Care Services have taken a pro-active approach to respond to the changes and introduction of the LPS.  A Strategic Delivery Group, and Workstreams meet on a regular basis to plan and prepare for the changes.  Further information on how this will be implemented will be shared shortly.

      Care Sector Providers may be approached by training providers offering courses on LPS.  East Riding Adult Social Care Services will be working with the East Riding Safeguarding Adults Board to offer training on the LPS changes in due course.  Therefore, you may wish to wait until this free provision is offered.
